GENERAL TERMS AND CONDITIONS
1. general / contractual performance
The general terms and conditions (GTC) apply to all products, services and deliveries, which are purchased through David Biedert Photography AG ("we" / "us"). By submitting an order you (the "customer") expressly agree to these terms and conditions.
Individual additional agreements are only valid if a written confirmation from David Biedert Photography AG is available.
2. contract
A sales contract is concluded when the customer has received an automated order confirmation from David Biedert Photography AG by email. With this email confirmation the sales contract is concluded and changes as well as cancellations can no longer be accepted at this point in time.
The customer must be at least 18 years old to place orders via the website. David Biedert Photography AG does not accept credit purchases for persons under 18 years. We reserve the right to refuse a customer's order (for demonstrable reasons).
We only accept orders and delivery addresses within Switzerland and the Principality of Lichtenstein, and for a fee also to the surrounding countries (Germany, Austria, France, Italy).
3. copyright
The author of the photographs offered on David Biedert Photography AG is the photographer David Biedert himself,
By purchasing a product with contents of the photographs made available on David Biedert Photography AG, the customer acquires exclusively the real property of the product. Rights of use for reproduction of any kind, distribution, editing as well as for public access are not included and absolutely prohibited.
4. offer & products
The prices in our offers and order confirmations are in CHF (Swiss Francs) and are generally binding. The prices include payment and shipping charges as well as value added tax. David Biedert Photography AG is subject to value added tax. David Biedert Photography AG always strives to provide correct product information. Minor technical deviations (especially cropping and color of the printout) of the delivered product are allowed and do not constitute a defect, as long as they are within the customary limits and the contractual purpose is not significantly limited. The product illustrations may differ from the actual product, depending on which screen is used and which colour settings are stored. They are of a purely informative nature. Nevertheless, we endeavour to depict our products as realistically as possible. In particular, no liability can be accepted for the accuracy, completeness and topicality of the information. David Biedert Photography AG reserves the right to change prices and assortment at any time.
5. delivery & delivery times
Information on delivery times is not binding. David Biedert Photography AG is always anxious to keep the delivery times given at the time of contract conclusion. The product is produced at the time of contract conclusion. As far as no other written agreements have been made, the delivery is usually ex works of David Biedert Photography AG. If in exceptional cases it is not possible for us to meet the agreed upon deadlines or if the product is no longer available, we will contact the customer by e-mail or telephone and the customer will get his money back.
The shipping is done with the Swiss Post (abroad by DHL). The goods must be checked immediately upon arrival for correctness, completeness and intactness. Transport damage must be reported and documented immediately, at the latest after five calendar days. David Biedert Photography AG strives to produce and deliver all ordered products as quickly as possible. The delivery time is normally 7-10 working days. We are entitled to partial deliveries. Subsequent shipments will be delivered postage free. As mentioned in article 1, deliveries are limited to delivery addresses within Switzerland and the Principality of Lichtenstein. We also deliver to surrounding countries (Germany, Austria, France, Italy), this for a fee. The transport and delivery costs are calculated per country / order and agreed with the customer. The delivery time abroad is normally 10-20 working days.
In case of delivery disturbances which are not caused by David Biedert Photography AG and which are not under the influence of David Biedert Photography AG, we reserve the right to withdraw from the contract, if the obstacle to performance is not temporary in nature, without any liability for damages. This applies in particular to the effects of force majeure. We are not in default of delivery for the period of the obstacle. Services already paid for will be reimbursed in the event of withdrawal.
